Rocklin Board Appeals CA DoE Decision

On February 1st 2024, the district received a letter from the California Department of Education notifying it that the Gender Notification Policy passed in September 2023 was illegal.

The letter details the consequences for the district if the policy is not repealed:

  • The withholding of all or part of the local agency’s relevant state or federal fiscal support in accordance with state or federal statute or regulation;
  • Probationary eligibility for future state or federal support, conditional on compliance with specified conditions;
  • Proceeding in a court of competent jurisdiction for an appropriate order compelling compliance.

Rather than rescinding the illegal policy, following California law, and saving the district untold lawyer fees, the board majority doubled down and appealed the decision. This sets up another legal confrontation with the state, as well as pulling money for our teachers and students out of the district.
